For the purpose of these Terms & Conditions, all mention of Mother Justice Network (hereinafter, “MJN”) includes DVSur5r Network, DBA Mother Justice Network; Finding Your Best Self Retreats; Justice TIPs app; The Maze of Coercive Control; websites, social media profiles, pages and groups; products and/or services — past, current and future — offered by MJN. Mother Justice Network was created to serve Protective Parents, and promote trauma-responsive practices to systems and professionals who work with families who are targeted by abusers. This website is owned and operated by Mother Justice Network, and these Terms & Conditions, as set forth herein, are the terms and conditions under which you may use MJN contents, products and services offered within this website and elsewhere. By accessing or using the website, or any of our contents, products or services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

To use MJN, or any or all of its content, products and/or services, as a Protective Parent, Professional or Public Member, you must agree that:

• The information contained within MJN is not, nor is it ever, a substitute for the professional advice of an Attorney, Medical Doctor, Psychiatrist, Counsellor, Financial Advisor, or any other degreed, licensed or certified professional. The information provided by MJN does not constitute legal or professional advice, nor is it intended to be.
• By using MJN services, you agree that any and all decisions you make based on information gained by your use of MJN, and the results or consequences thereof, are solely your own. Under no circumstances will you, or your estate, hold MJN liable for any actions or inactions that you take; you agree that your use of MJN is completely voluntary, and that MJN cannot be held liable for any loss or cost incurred by you or your estate, or any person related or associated with you or your estate, as a result of services, materials or products of MJN that were utilized by or offered to you.
• There is no guarantee, expressed or implied, for any particular outcome of your circumstances on the basis of your use of MJN, and MJN is not responsible for your actions, decisions or choices made based on your use of MJN website, products or services. MJN, in its entirety, accepts no responsibility or liability for any harm — real or intangible — from your use of, or dissemination of information, contained in this website and/or in the services and/or in the products offered by MJN and utilized by you.
• In order to legally access or utilize our website, products and/or services, you must be at least 18+ years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms & Conditions as a binding agreement; or you must have the permission of your parent or legal guardian to do so. You are not allowed to use this website and receive services if doing so is prohibited in your country or under any law or regulation applicable to you. MJN is not responsible, and may not be held liable for, a minor’s use of its service, if that minor has done so without permission from a parent or legal guardian.
• If you do not agree to these Terms & Conditions, you may not use MJN content, products or services; by engaging or utilizing MJN content, products and services, you explicitly and implicitly agree to all terms and conditions herein.

JUSTICE TIPS APP: The Justice TIPs app has been developed for the use and purpose of Protective Parents served by the Mother Justice Network. For the purpose of MJN, “Protective Parent” is defined as: 1) an adult victim or survivor of family violence; and 2) who has one or more children-in-common with a Counter-parent (defined as a person who uses coercive, controlling, abusive or counter-parenting tactics against a current or former intimate partner or their children-in-common to maintain dominance, or retaliate, against that protective parent pending- or post-separation); and 3) who is or was the birthing and/or primary caretaking parent to the children before the parent parties separated, or before the Counter-parent sued the birthing/primary caretaking parent for custody; and 4) who has lost custody, or is in danger of losing custody of the children-in-common to their Counter-parent, due to the legal aggression of the Counter-parent, their legal allies, and/or the apathy, neutrality, insufficiency, or hostility of responding systems that should be vested in protecting victims of family violence; and 5) who has concerns for the safety and well-being of the children-in-common when they are in the care or custody of the Counter-parent; and 6) whose use of the app does not, in the best estimation of Mother Justice Network, present a safety risk to others using or accessing the app.

MJN reserves the right to grant or deny access to any or all functions of Justice TIPs, in whole or in part, on the parameters set forth in these Terms & Conditions; and further reserves the right to change access privileges based on knowledge and/or information collected from publicly- or privately-accessed sources. The granting or denial of app access is not based on moral judgment of character, but whether a person requesting use of the full functioning of the app fits the description of a Protective Parent served by MJN, based on its screening policies and practices. A Protective Parent, as defined herein, does not need to be a current or active user of other MJN services in order to utilize the app; as long as MJN has not revoked app access or privileges, someone screened in as a MJN Member may access the app for life. Revocation of MJN Member/Protective Parent status, for the purpose of the Justice TIPs app, will merely revoke that person’s lifetime access to the profiling, rating and favoriting functions of the app; that person may still purchase monthly or annual subscriptions to the app to review professionals’ ratings, at the Public Subscription rate.

For professionals who purchase subscription to the Justice TIPs app for the purpose of submitting their own profile and identifying themselves as a professional who follows Trauma Informed Practices, they must agree to conduct their professional work with persons identifying as trauma or family abuse survivors according to the principles enumerated on the Justice TIPs website; three or more ratings to the contrary will cause MJN to revoke their trauma-responsive designation. Subscriptions purchased under the “Professional” designation have access to submitting their own profile with a “trauma-informed practices” designation, and to review ratings of other professionals, and the heart-warming knowledge that they are helping to fund critical MJN work. No refunds shall be issued for professional subscriptions that are cancelled early, for any reason.

Members of the public who purchase subscriptions to the Justice TIPs app will only have access to view ratings submitted by others, and the privilege of basking in the glow of knowing that their subscription is largely supporting the work of assisting protective parents to help make their vulnerable and abused children safe. No refunds shall be issued for Public subscriptions that are cancelled early, for any reason.

FINDING YOUR BEST SELF RETREATS: Retreat fees are determined on a number of factors, and are published when retreats are announced. Retreat participants are expected to follow the rules and guidelines of the retreat facility, and keep the location of the retreat, as well as the names and identifying information and circumstances of other retreat participants, confidential; pictures cannot be taken without permission from all involved. Recordings by participants are prohibited. Retreats are alcohol and (street) drug-free, for the safety of all. Participants bear the responsibility and liability for damage they do to retreat facilities or property. Because retreats facilities are paid ahead of time, refunds are not issued to retreat participants who fail to attend, unless they withdraw before the retreat facility is paid.

FEES: MJN reserves the right to change fees for services and/or products displayed at any time, and to correct pricing errors that may inadvertently occur.

REFUND POLICY: In general, there will be no refunds for products offered by MJN (including Justice TIPs subscriptions); refunds for services (such as retreats or trainings) will be considered on a case-by-case basis, and only if the notice of cancellation is received before any third-party facilities are sent payment.

RIGHT TO CHANGE SERVICES: MJN may, without prior notice, change, discontinue, limit, suspend, or terminate, temporarily or permanently, content, products or services, without notice and liability for any reason, or for no reason; including if, in our sole determination, you violate or fail to meet any provision of these Terms & Conditions, or any applicable law or regulation. You may discontinue use and request to cancel your Justice TIPs account and/or MJN services at any time; Justice TIPs subscriptions may be cancelled, but no refund will be issued.

OWNERSHIP OF INTELLECTUAL PROPERTY, COPYRIGHTS, & LOGOS: MJN content, products and services, and all related materials therein or transferred thereby, including, without limitation: software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of Mother Justice Network. Except as explicitly provided herein, nothing in these Terms & Conditions shall be deemed to create a license in or under any such Intellectual Property Rights; and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof, without the expressed and written permission of Kathryn Jones, founder of Mother Justice Network, creator of The Maze of Coercive Control, and developer of the Justice TIPs app.

INDEMNIFICATION: You agree to indemnify and hold the entirety of MJN harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees) made against them by any third party due to, or arising out of, or in connection with, your use of the website or any of the content, products or services offered on this website.

LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, in no event shall MJN be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service(s), products or content of the entirety of MJN.

To the maximum extent permitted by applicable law, MJN assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

RIGHT TO CHANGE & MODIFY TERMS: MJN reserves the right to modify these terms from time to time at our sole discretion; therefore, you should review this page periodically. When we change the Terms & Conditions in a material manner, we will notify you that material changes have been made to the Terms & Conditions. Your continued use of the website or our content, products or services, after any such change, constitutes your acceptance of the new Terms & Conditions. If you do not agree to any of these, or any future version of the Terms & Conditions, do not use or access (or continue to access) the website or the content, products or service(s) offered herein.

INFORMATIVE EMAILS & CONTENT: If you wish to receive, from time to time, promotional messages and materials from us, by mail, email, or any other contact form you may provide us with (including your phone number for calls or text messages), you must opt in by signing up for MJN marketing under the “Receive Our Newsletter” link. PREFERENCE OF LAW & DISPUTE RESOLUTION: These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and to the services, shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the United States, as determined by the business address of MJN.
